§ 1. General provisions

This Privacy Policy defines the principles of processing personal data obtained via the website https://fashioneditorial.pl (hereinafter referred to as: "Website").

The personal data controller is Oliwia K., residing in Kraków, conducting unregistered business activity, hereinafter referred to as the "Controller".

§ 3. Type of data processed, purposes and legal basis

The administrator collects information regarding:

• natural persons,
• People running a business,
• Persons representing legal persons or organizational units that are not legal persons (hereinafter collectively referred to as "Users").

Users' personal data are collected in the following cases:

1. Zakup ebooka, szkolenia online lub konsultacji
   • Podstawa prawna: niezbędność do wykonania umowy sprzedaży (art. 6 ust. 1 lit. b RODO).
   • Zakres zbieranych danych: imię i nazwisko, adres e-mail, dane adresowe (jeśli wymagane do faktury lub dostawy), numer telefonu.
   • Obowiązek podania danych: Podanie danych jest dobrowolne, ale niezbędne do realizacji zamówienia. Brak podania danych uniemożliwi zawarcie umowy i realizację zamówienia.
2. Subskrypcja newslettera (w tym darmowy ebook)
   • Podstawa prawna: zgoda Użytkownika (art. 6 ust. 1 lit. a RODO).
   • Zakres zbieranych danych: adres e-mail.
   • Cel przetwarzania: Wysyłka newslettera z informacjami o nowościach, promocjach, darmowych materiałach oraz udostępnienie obiecanego darmowego ebooka po zapisie.
   • Prawo do cofnięcia zgody: Użytkownik może w każdej chwili zrezygnować z newslettera, klikając w link rezygnacji znajdujący się w każdej wiadomości e-mail lub kontaktując się z Administratorem.
   • Obowiązek podania danych: Podanie danych jest dobrowolne, ale niezbędne do otrzymywania newslettera i dostępu do darmowego ebooka.
3. Kontakt poprzez formularz kontaktowy
   • Podstawa prawna: niezbędność do realizacji żądania Użytkownika poprzedzającego zawarcie umowy (art. 6 ust. 1 lit. b RODO) lub prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO) w celu prowadzenia korespondencji i udzielania odpowiedzi na zapytania.
   • Zakres zbieranych danych: imię i nazwisko, adres e-mail, treść wiadomości.
   • Obowiązek podania danych: Podanie danych jest dobrowolne, ale niezbędne do obsługi zapytania.
4. Utworzenie konta w Serwisie
   • Podstawa prawna: niezbędność do wykonania umowy o świadczenie usług drogą elektroniczną (art. 6 ust. 1 lit. b RODO).
   • Zakres zbieranych danych: imię i nazwisko, adres e-mail, hasło, historia zakupów.
   • Obowiązek podania danych: Podanie danych jest dobrowolne, ale niezbędne do utworzenia i prowadzenia konta w Serwisie.
5. Analiza statystyk Serwisu (Google Search Console, Independent Analytics)
   • Podstawa prawna: prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO) w celu optymalizacji funkcjonowania Serwisu, analizy ruchu i poprawy jego widoczności w wyszukiwarkach.
   • Zakres zbieranych danych: Anonimowe dane statystyczne dotyczące ruchu na stronie, źródła wejść, fraz kluczowych. Administrator nie zbiera danych osobowych umożliwiających identyfikację użytkownika w ramach tych narzędzi.

§ 4. Users' rights

Users have the right to:

• Withdrawal of consent (Article 7, paragraph 3 of the GDPR) – applies to data processed on the basis of consent, e.g. newsletter.
• Objection to data processing (Article 21 of the GDPR) – against processing based on the legitimate interest of the Administrator.
• Delete data ("right to be forgotten") (Article 17 GDPR) – in certain situations, e.g. when the data is no longer necessary for the purposes for which it was collected.
• Restrictions on data processing (Article 18 of the GDPR) – in certain situations, e.g. when you question the accuracy of the data.
• Access to data (Article 15 of the GDPR) – the right to obtain information about what data is being processed and to receive a copy of it.
• Data portability (Article 20 of the GDPR) – the right to receive data in a structured, commonly used and machine-readable format and to transmit it to another controller, provided that the processing is based on consent or a contract and is carried out by automated means.
• Data rectification (Article 16 of the GDPR) – the right to request the correction of incorrect data or the completion of incomplete data.
• File a complaint with the supervisory authority - the President of the Office for Personal Data Protection.

§ 5. Protection of personal data

The Administrator makes every effort to protect the personal data of Users against unauthorized access, loss or disclosure. The Administrator applies appropriate technical and organizational measures to ensure the protection of processed personal data, including data encryption (SSL certificate), regular backups and limiting access to data.

§ 6. Data retention period

Personal data will be stored for the following periods:

• Data related to the execution of orders (e-books, training, consultations): For the period required by accounting regulations (5 years from the end of the fiscal year in which the financial event occurred).
• Data related to the user account: Until the account is deleted by the User or by the Administrator at the User's request.
• Data processed on the basis of consent (e.g. newsletter): Until the User withdraws consent.
• Data from the contact form: For a period of 1 year from the last contact or until an effective objection to data processing is raised.
• Statistical data (anonymous): May be stored for a longer period for analytical purposes, as long as it does not enable users to be identified.

§ 7. Sharing of personal data

The Administrator may share Users’ personal data with the following categories of recipients, to the extent necessary to provide services:

• hosting service providers (e.g. SeoHost),
• IT service providers,
• electronic payment service providers (e.g. payment operators, banks),
• email marketing system providers (e.g. FluentCRM),
• to providers of accounting and legal services,
• entities authorised to receive them under applicable law (e.g. state authorities).

§ 8. Transfer of data to third countries

Users' personal data may be transferred to recipients located outside the European Economic Area (EEA), in particular when using the services of technology solution providers (e.g. analytical tools, mailing systems). In such a case, the Administrator ensures appropriate safeguards to protect personal data, in particular through the use of standard contractual clauses approved by the European Commission or the use of services of entities with appropriate certificates (e.g. Privacy Shield - if still in force or its successors).

The Website uses cookies and other tracking technologies, such as pixels or scripts. § 10. Automatyczne decyzje i profilowanie

Administrator nie podejmuje wobec Użytkowników zautomatyzowanych decyzji, w tym decyzji będących wynikiem profilowania, które wywoływałyby skutki prawne dla Użytkownika lub w podobny sposób istotnie na niego wpływały.

§ 11. Links to other websites and social media

The Website may contain links to other websites and integrations with social networking sites (such as Facebook, X/Twitter, Pinterest, LinkedIn). Clicking on these links or using the sharing buttons may result in the User's data being processed by these sites in accordance with their own privacy policies. The Administrator is not responsible for the privacy policies used by these external entities.

§ 12. Changes to the Privacy Policy

The Administrator reserves the right to introduce changes to the Privacy Policy. Changes come into effect upon their publication on the Website. The Administrator will inform Users about significant changes to the Privacy Policy by publishing information on the Website or via e-mail (in the case of newsletter subscribers).
